Last updated: February 2026
1. Acceptance of Terms
By accessing or using Essayly's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. We may update these terms from time to time; continued use after changes constitutes acceptance.
2. Description of Service
Essayly provides an AI-powered writing assistant and related tools to help users draft, edit, and improve written content. We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice where practicable.
3. Account and Eligibility
You must create an account to use certain features. You agree to provide accurate information and to keep your account credentials secure. You must be at least 13 years of age (or the age of majority in your jurisdiction, if higher) and have the legal capacity to enter into these terms. You are responsible for all activity under your account.
4. Acceptable Use
You agree not to use the service to:
- Violate any applicable law or third-party rights.
- Submit content that is illegal, harmful, abusive, defamatory, or infringing.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Use the service for automated scraping, resale, or redistribution in a manner that violates these terms.
- Interfere with or disrupt the integrity or performance of the service.
We may suspend or terminate accounts that violate acceptable use.
5. Intellectual Property
You retain ownership of content you submit. By submitting content, you grant us a limited license to use, process, and store it as necessary to provide and improve the service. Essayly's name, logo, software, and other materials are our intellectual property and may not be used without our prior written consent.
6. Payment and Refunds
Paid plans are billed according to the pricing displayed at the time of purchase. Payment is processed through our designated payment provider (e.g., Stripe). All fees are non-refundable; we do not provide refunds for any payments. We may change pricing with advance notice; continued use after a price change constitutes acceptance.
7. Disclaimers
The service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee that the service will be uninterrupted, error-free, or that output will meet your specific requirements. You use the service at your own risk.
8. Limitation of Liability
To the maximum extent permitted by law, Essayly and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the service. Our total liability for any claims related to the service shall not exceed the amount you paid us in the twelve months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Essayly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the service, your content, or your violation of these terms or any law.
10. Termination
You may close your account at any time. We may suspend or terminate your access for breach of these terms, non-payment, or for any other reason with notice where appropriate. Upon termination, your right to use the service ceases; provisions that by their nature should survive (e.g., disclaimers, limitation of liability, indemnification) will survive.
11. Changes to Terms
We may modify these Terms of Service at any time. We will post the updated terms on this page and update the "Last updated" date. Material changes may be communicated via email or in-product notice. Your continued use after the effective date of changes constitutes acceptance. If you do not agree, you must stop using the service.
12. Governing Law and Disputes
These terms are governed by the laws of the jurisdiction in which Essayly operates, without regard to conflict of law principles. Any dispute arising from these terms or the service shall be resolved in the courts of that jurisdiction, except where prohibited. You may have additional rights under the laws of your residence.
